1. License grant
Subject to this agreement and payment of the applicable fee, you receive a limited, personal, non-exclusive, non-transferable, revocable license to install and use one copy of SPECTER Imaging on one activated Windows device for personal, non-commercial use. The software is licensed, not sold.
2. Permitted personal use
You may use SPECTER Imaging for personal and hobbyist paranormal investigation, environmental observation, evidence capture, and related recreational activity. You may publish recordings, screenshots, clips, and reports created with the software on personal channels, including channels with incidental platform advertising or monetization.
3. Commercial use
Paid investigation services, television, film, commissioned streaming productions, rentals, sublicensing, and other business use require a separate written commercial license. Contact support@specter-imaging.com.
4. Activation and license scope
Each key activates one Windows device. Activation may transmit the key, purchaser email, product identifier, a one-way device identifier, and activation status to the licensing service. Keep the key confidential and do not publish, sell, or share it.
5. Restrictions
Except where applicable law or an open-source license expressly permits it, you may not redistribute, sell, rent, sublicense, circumvent security or activation, reverse engineer proprietary SPECTER components, remove notices, or use the software unlawfully. These restrictions do not limit rights that cannot lawfully be waived.
6. Open-source and third-party components
The software includes separately licensed components. Their licenses control for covered components. Nothing in this agreement limits rights granted by an applicable open-source license, including a permitted right to inspect, modify, replace, reverse engineer, or redistribute that component. Notices, license texts, and source information are installed with the software and listed on the Open Source page.
7. Your content and local data
Your recordings, screenshots, archives, annotations, sensor logs, and reports remain yours. Investigation content is primarily stored locally. You are responsible for backups, lawful capture, notice and consent, secure storage, and disclosure. Online processing is described in the Privacy Policy.
8. Hardware, networks, and services
The software can interoperate with cameras, microphones, depth sensors, network video recorders, wireless sensors, Cloudflare Tunnel, and other third-party products. Their availability, compatibility, security, and terms are controlled by their providers. You are responsible for permission to access every device, network, location, stream, and recording source.
9. Investigation and safety notice
SPECTER Imaging is an environmental imaging, pattern-analysis, and evidence-capture tool. Its classifications and alerts are observational aids, not professional scientific, medical, legal, electrical, structural, fire, security, or emergency advice. It does not guarantee detection, identification, proof, or absence of any phenomenon. Do not trespass, enter unsafe structures, interfere with emergency services, defeat safety controls, or place anyone at risk based on an alert.
10. Updates
Updates may correct, secure, or change functionality. A third-party integration may be discontinued when continued operation is impracticable, unlawful, insecure, or dependent on a discontinued service.
11. Purchases and refunds
Purchases are governed by the Terms of Sale and Refund Policy. Nothing limits a mandatory consumer right.
12. Warranty disclaimer
To the maximum extent permitted by law, the software is provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, or compatibility.
13. Limitation of liability
To the maximum extent permitted by law, the publisher is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or loss of data, profits, revenue, business, goodwill, or investigation results. Total liability will not exceed the amount paid for the affected SPECTER Imaging license. Limits do not apply where liability cannot lawfully be limited.
14. Indemnity
To the extent permitted by law, you agree to defend and indemnify the publisher from third-party claims arising from unlawful use, unauthorized recording or access, violation of privacy or property rights, or breach of this agreement.
15. Termination
Your proprietary software rights terminate if you materially breach this agreement and do not cure when cure is required by law. Termination does not affect rights granted directly under an open-source license.
16. Governing law and consumer rights
California law governs, without regard to conflict-of-law rules. California courts have jurisdiction except where mandatory law permits otherwise. Consumers retain all mandatory rights provided by the law of their residence.
17. General terms
This agreement and the referenced sale and privacy terms form the agreement concerning purchase and use. If one provision is unenforceable, the others remain effective. Failure to enforce is not a waiver.
