SPECTER LICENSE AGREEMENT

This License Agreement ("Agreement") governs your use of the SPECTER software application, together with any associated wireless sensor node firmware and documentation (collectively, "SPECTER" or "the Software"), published by SPECTER ("Licensor," "we," "us"). By purchasing a license key, installing, or using SPECTER, you ("Licensee," "you") agree to the terms below. If you do not agree, do not install or use the Software.

1.0GRANT OF LICENSE

Upon purchase and activation of a valid license key, Licensor grants you a personal, non-exclusive, non-transferable, revocable license to install and use one copy of SPECTER, bound to the device on which it is activated, for the term of this Agreement.

This is a license, not a sale. Licensor retains all right, title, and interest in and to the Software, including all copies, updates, and derivative works.

2.0PERMITTED USE

Your license covers personal, non-commercial use of SPECTER, including:

• Personal and hobbyist paranormal investigation, exploration, and recreational use.
• Recording, saving, and reviewing evidence, footage, and sensor data captured with the Software for your own purposes.
• Sharing footage, screenshots, clips, and recordings captured with SPECTER on social media, video platforms (e.g. YouTube, TikTok), blogs, and personal channels, including channels that carry incidental advertising or platform monetization, provided such sharing remains personal content creation and not a paid commercial engagement as described in Section 3.

3.0COMMERCIAL USE

"Commercial Use" means use of SPECTER in connection with a business, paid service, or for-profit production, including but not limited to:

• Paid investigation services offered to clients.
• Use in television, film, or streaming productions.
• Use under sponsorship, endorsement, or paid partnership arrangements specifically involving SPECTER.
• Resale, rental, or sublicensing of the Software or license keys.

Commercial Use requires a separate, signed Commercial License Agreement with Licensor prior to such use. To request a commercial license, contact support@specter-imaging.com.

4.0RESTRICTIONS

You may not:

• Reverse engineer, decompile, or disassemble the Software, except to the extent such restriction is prohibited by applicable law.
• Redistribute, resell, rent, lease, or sublicense the Software or your license key.
• Remove or alter any copyright, trademark, or other proprietary notices contained in the Software.
• Use SPECTER to violate any applicable law, or to violate the privacy or property rights of any third party (including trespassing on property without authorization while using the Software).
• Circumvent or attempt to circumvent the license activation system.

5.0INTELLECTUAL PROPERTY

SPECTER, including its software, wireless node firmware, designs, trademarks, and documentation, is the property of Licensor and is protected by applicable intellectual property laws. This Agreement does not grant you any ownership interest in the Software.

6.0YOUR CONTENT

Recordings, screenshots, evidence archives, and other content you capture using SPECTER ("Your Content") belong to you. Licensor claims no ownership over Your Content and does not require access to it to operate the Software.

7.0THIRD-PARTY HARDWARE

SPECTER is designed to work with certain third-party sensors and hardware (for example, depth cameras, capture devices, and IP camera systems). Use of such hardware is governed by the applicable manufacturer's own terms. Licensor is not responsible for the performance, availability, or compatibility of third-party hardware.

8.0DISCLAIMER OF WARRANTY

SPECTER is provided "AS IS" without warranty of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement. SPECTER is a detection and environmental analysis instrument; it reports sensor readings and pattern classifications, and does not itself constitute scientific proof of paranormal phenomena.

9.0LIMITATION OF LIABILITY

To the maximum extent permitted by law, Licensor shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of SPECTER. Licensor's total liability under this Agreement shall not exceed the amount you paid for your license.

10.0TERM & TERMINATION

This Agreement is effective upon activation of your license key and continues until terminated. Licensor may terminate this Agreement if you breach any term of this Agreement. Upon termination, you must cease all use of the Software.

11.0UPDATES

Licensor may release updates to the Software from time to time. Your license entitles you to free updates for the current version line, as described at time of purchase. Licensor may update this Agreement; material changes will be posted at this URL with a new effective date.

12.0GOVERNING LAW

This Agreement is governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute arising under or relating to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in California.
